DuPage County, Illinois DUI Laws

Under Illinois law 625 ILCS 5/11-501, you may be charged and convicted of DUI if the prosecutor can show that you operated a motor vehicle with a blood alcohol content (BAC) of 0.08% or more. Drivers under the legal drinking age of 21 may be charged with DUI if they show any BAC, as Illinois has “zero tolerance” for underage drinking and driving. Finally, commercial drivers may be charged if they drive with a BAC of 0.04% or above.

625 ILCS 5/11-501 sets out several types of penalties for DUI offenders, including probation, jail time, fines, driver’s license suspension, alcohol classes, and more. The penalties for DUI increase further if you have prior DUI convictions or if other circumstances exist in your case, such as a having a child under 16 in the car or having a BAC over a certain amount. The following is a brief look at some possible penalties for first and second DUI convictions.

  • 3-7 years
  • Add 1-3 years if a child was in the car
  • Mandatory extra 90 days if BAC over 0.16%
  • $2,500
  • Mandatory $25,000 if a child was in the car
